Mincoffs successfully defends Teesside venue

A popular Middlesbrough nightclub and event space has had its licence restored, thanks to legal support from Mincoffs Solicitors’ licensing specialist Matt Foster.

The Empire – which is the oldest existing late night premises in Middlesbrough city centre – recently closed due to a summary review, following an incident at the venue involving a member of its door staff.

Mincoffs’ licensing and gaming team represented The Empire at an initial hearing the following day, with a full hearing agreed for late April.

Prior to the hearing, partner and head of licensing and gaming Matt Foster worked closely with the client to bring about a change in management and security, and this was subsequently presented to legal representatives for the police, council, and licensing committee.

The team negotiated over a number of conditions and had an agreed position on the majority of issues, with a decision being delivered on the second day of the hearing.

As a result, the premises was ordered to remain closed for a further 21 days in order to put in place changes in relation to management, policies and procedures, and security.

Revised conditions were installed on the licence, which will be restored on 16th May, however no changes were made to the hours or licensable activities.

“The Empire is a popular event space which regularly hosts a variety of live music events and performances and is intrinsic to the nighttime economy in the city centre,” said Matt.

“We worked closely with our client to find a solution following the summary review, including a change in management and security in order to help restore trust in the venue.

“We are pleased with the result of the hearing and believe the changes put in place will bring about a positive outcome for all parties.”

On the first day of the hearing, the licensing and gaming team were also instructed on a summary review for another client, which was due to take place the following day.

“With the decision for The Empire due on the second day, it was imperative that the team worked effectively in order to represent both clients and we were able to arrange attendance at that hearing around the delivery of the decision on The Empire,” said Matt.

“This is a prime example of the high profile work we are regularly involved in and also the speed at which we are able to react and support our clients on any issues they may be experiencing.”
