Contentious probate refers to any dispute or disagreement regarding a deceased person’s will and the way in which their estate should be handled.

Losing a family member or loved one can be a challenging time for those left behind, and disagreements around the validity of the deceased’s will and assets can make it even more difficult.

You may feel you have been left out of a will unfairly, Mincoffs Solicitors’ expert team can advise on the legalities of contentious probate and the process of contesting a will or any other related dispute.

Such disputes can arise because of:

  • Contesting a will
  • Will invalidity claims, e.g. if the deceased was influenced by another or did not have capacity
  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975, e.g. if you feel you have been unfairly left out of a will
  • Executor and/or trustee authority
  • Executor and/or trustee’s duties and obligations
