Postnuptial Agreements

As prenuptial agreements have risen in popularity in recent years, so too have postnuptial agreements.  

While prenuptial agreements must be agreed prior to a marriage, a postnuptial agreement – sometimes called a postnup – can be drafted any time after you have tied the knot.  

Both are legal agreements which outline what belongs to each spouse and what is owned jointly, which can be relied upon in the event of the end of a marriage or civil partnership.  

While prenuptial agreements and postnuptial agreements are not yet legally binding documents, they should be upheld by the court if they have been prepared and executed correctly and are judged to be fair for both parties. With this in mind, it is imperative that you seek independent family law advice to ensure that you understand what the document details and its implications.  

There are a number of reasons you may be considering a postnuptial agreement. Circumstances can change after a wedding has taken place and a postnup may give one or both parties peace of mind when it comes to thinking about the future. This could include protecting family inheritance, stakes in a business, assets owned overseas or even to provide further security for dependents from a previous marriage, should the current relationship breakdown in the future. A postnuptial agreement cannot determine decisions regarding arrangements for children, as these can only be decided at the time of a divorce or legal separation.
