If you are looking to buy a property, it is important that you seek professional guidance through the process to ensure that all aspects of the transaction are handled effectively.

When purchasing a property, it is important to gather as much information as possible before committing to the Contract and one way to gather information is by ordering searches.  Standard searches provide information relating to potential contaminated land, flooding and past (present or future) mining that could affect the property.  A drainage search will confirm where the public sewers and water mains run and a local search which obtains information from the Local Authority and can provide details of planning permissions and building regulations for works carried out at the property.

If you are purchasing with the assistance of a mortgage, your lender will usually have certain requirements as to which searches are required.  If you are a cash buyer, you can opt to waive the requirement for searches, however we would always recommend they are obtained as your first option.

It is important to be aware of any defects in the Property before you exchange contracts.    Once exchange has taken place, you will not be entitled to compensation from the Seller if you need to correct any physical defects.   It is recommended that a full structural survey is obtained to provide you with details of any potential issues with the structure of the property you are purchasing.  This can often be arranged via your mortgage broker and is not part of the conveyancing searches and the survey is not arranged by your solicitor.
