Contentious Probate

Losing a family member or loved one can be a challenging time for those left behind, and disagreements around the validity of the deceased’s Will and assets can make it even more difficult.

‘Contentious probate’ means any dispute or disagreement regarding a deceased person’s Will and the way in which their estate should be handled. Such disputes can arise because of:

  • The validity of the deceased’s Will e.g. if the deceased was influenced by another or did not have capacity
  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975
  • The way in which the estate is distributed
  • Administration costs
  • Executor and/or trustee authority
