Contesting a Will

‘Contentious probate’ means any dispute or disagreement regarding a deceased person’s Will and the way in which their estate should be handled. Such disputes can arise because of:

  • The validity of the deceased’s Will e.g. if the deceased was influenced by another or did not have capacity
  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975
  • The way in which the estate is distributed
  • Administration costs
  • Executor and/or trustee authority
